Location: Otis Town Hall, One North Main Road, Otis

 

Conservation Commission Members present: David Sarnacki, Roger Meyer, Domenic Battista, Bruce Wall and Jeff Laramy

Conservation Commission Members absent: None

Staff and others present: Kristen Brown Secretary; David Fishman; Chris Tryon with Berkshire Geo-Technologies.

Opening items/Introduction of Commission members and staff. Dave Sarnacki opened the meeting at 6:00 p.m. He noted that the meeting is being recorded. This special Conservation Commission meeting was scheduled in order to open a public hearing that was received in time to be heard at the 5/23/16 meeting, but was inadvertently missed when doing the legal notice. Therefore, since the error was on the side of OCC, we scheduled this meeting to hear the following application, with all due respect for timely submission to the commission:

Public Hearing – RDA – Submitted by David & Carol Fishman, 42 S. Gate Island Rd., map 17C lot 13, regarding the replacement of a failed septic system and the construction of an addition onto the existing dwelling within the 100’ BZ of Otis Reservoir. Dave opened this hearing and invited the applicants to address the commission. Chris Tryon with Berk. Geo-Tech, and David Fishman, property owner, addressed the commission and presented the work plans to the commission. Dave asked if there were any questions stemming from the site visit – per RM, need to mark the EC on the print, for the extra area as indicated by OCC. Chris & Mr. Fishman marked and signed the print with required information and the print was dated and signed by the commission. Dave asked if there was a required set-back for the septic and per the print, there was not a variance required. Dave asked if any other questions and the commission felt there were none. Dave made a motion for a -3 determination with the following conditions: no heavy equipment in the resource area; all equipment serviced and stored outside resource; debris removed from resource or covered daily; OCC reserves the right to inspect property & work for 3 years from date of approval. RM 2nd the motion and the commission voted unanimously for a -3 determination with the above conditions.
