CONSERVATION COMMISSION

1/18/2022 MEETING MINUTES

 

Location:  Otis Town Hall, One North Main Road, Otis ** Remote Meeting Via Zoom ***

 

Conservation Commission Members present:  Dave Sarnacki, Roger Meyer, Bruce Wall, Jennifer Cole (new alternate Commissioner).

 

Conservation Commission Members absent:  Jeff Laramy, Domenic Battista.

 

Staff and others present:  Kristen Brown OCC Admin Secretary; Ryan Nelson with R. Levesque; Michelle Zalot; Mike Kulig; Chris Harding (sp.). Others in attendance but unknown, as not announced/confirmed, nor signed-in with a full name on the Zoom application.

 

Opening items/Introduction of Commission members and staff.  Dave opened the meeting at 6:00 p.m., and noted that the meeting is being recorded. The deadline for applications for the 2/15/2022 meeting is on Wednesday February 2, 2021 @ 6:00 PM. The next office hours, for the February 15, 2022 meeting, is also Wednesday February 2, 2022 from 6:00 –9:00 PM. Dave introduced the members of the commission, and asked everyone to turn off/down their cell phones for the duration of the meeting.

 

Minutes:  Dave made a motion to approve minutes from the December 21, 2021 meeting; RM 2nd the motion and the Commission voted unanimously to approve the minutes from the December 21, 2021 meeting.

 

  • Public Hearing – NOI – Submitted by SK Design on behalf of Mark Amanti w/MBA Realty LLC, 1401 Reservoir Road, map 16 lot 45, regarding the construction & maintenance of a private marina within the associated resource areas of Otis Reservoir. Dave opened this hearing and asked if the Commission had any issues with the project as proposed. Since the applicant preemptively performed a site wetlands delineation, which was forwarded to OCC, Dave made a motion that based upon the site inspection, project is approved, with the following to be added to the NOI: 1. Stairs to the docks area will be added; 2. One birch on the west end will be removed; 3. applicant will vista prune; 4. Solar lighting will be installed to public area(s). Dave asked if any other issues or concerns, and with none being stated, made a motion to approve the NOI and issue an OOC with standard and special conditions, including the addition of above listed work. BW & RM 2nd the motion and the Commission voted unanimously to approve this project and issue an Order of Conditions as outlined above, and the Commission voted unanimously to approve the project and issue an OOC.

 

  • Public Hearing – RDA – Submitted by Larkum Lake Realty Co., LLC, 620-622 Reservoir Road, map 15 lot 60, regarding the installation of a 10’ x 18’ shed within the BZ of BVW. Dave opened this hearing and asked if any issues stemming from the site inspection, and per RM all is straight forward. Therefore, Dave made a motion for a -3 determination with standard conditions. Rm 2nd the motion and the Commission voted unanimously to issue a -3 determination with standard conditions.

 

  • Public Hearing – NOI – Submitted by Kelly, Granger, Parsons & Assocs., Inc. on behalf of Arthur & Joan Tenser, 1 Derr Run, map 10E lot 28, regarding the replacement of existing septic with a new tank & pump within the BZ of Benton Brook. Ave opened this hearing and asked if there were any questions or concerns stemming from the site inspections, and per everything is all set, and project is OK as presented. Therefore, Dave made a motion to issue a -3 determination with standard conditions. BW 2nd the motion and the Commission voted unanimously to issue a -3 determination with standard conditions.

 

  • Public Hearing – RDA – Submitted by Berkshire Eng., Inc. on behalf of Todd Brouillette, 280 Kibbe Road, map 17C lot 65, regarding the upgrade of septic system within the BZ of Otis Reservoir. Dave opened this hearing and asked if any issues stemming from the site inspection and per RM the only thing is to add a Pine Tree to be removed in order to perform the work. Therefore, Dave made a motion to add the Pine Tree removal to the RDA, and to issue a -3 determination with the standard conditions. RM 2nd the motion and the Commission voted unanimously to issue a -3 determination with standard conditions.

 

  • Public Hearing – RDA – Submitted by Berkshire Eng., Inc. on behalf of Barry Macklin, 66 Loop Dr., map 403 lot 92, regarding walkway & drainage improvements within the 50-100’ BZ of Benton Pond. Dave opened this hearing and asked if any issues stemming from the site inspection and per RM there are no issues with this project. Therefore, Dave made a motion for a -3 determination with standard applicable conditions. BW 2nd the motion and the Commission voted unanimously to issue a -3 determination with standard conditions.

 

  • Public Hearing – NOI – Continuation from December 21, 2021 Meeting – Submitted by R. Levesque Associates, Inc., on behalf of Michele Zalot, 752 Tolland Road, map 17 E lot 10, regarding the demo and rebuild of existing home & septic system with associated site improvements, within the BZ to bank of Otis Reservoir. Dave opened this hearing and requested an update. Per KB, no full-size plans received yet by the Commission, and cannot move forward until plans are approved. Therefore, Dave made a motion to continue this hearing to allow for plans to be received and site inspections to be completed; and for KB to follow up on getting applicant’s hard copy plans sent to OCC. BW 2nd the motion and the Commission voted unanimously to continue this hearing until the 2/15/22 meeting.

 

 

OTHER BUSINESS

 

Enforcement Orders/Letters:

 

 

  • Enforcement Order – on agenda for Follow-up – David Roffo, 134 Kibbe Road, map 17C lot 45, regarding unauthorized paving within the BZ of Otis Reservoir. Dave opened this hearing and reminded all that this was still on agenda for follow-up – no action needed at this time.

Dave made a motion to adjourn the meeting at 6:37 PM. DB 2nd the motion and the Commission voted unanimously to adjourn the meeting.
