2/15/2016 MEETING MINUTES
Location: Otis Town Hall, One North Main Road, Otis

 

Conservation Commission Members present: David Sarnacki, Roger Meyer and Jeff Laramy

Conservation Commission Members absent: Bruce Wall and Dominic Battista

Staff and others present: Kristen Brown Secretary; Sarah Schultz; Gary & Lori McCauley; Robert Mason; Jon Goddard; Jennifer Levesque; Emily Walsh.

 

Opening items/Introduction of Commission members and staff. Dave Sarnacki opened the meeting at 6:00 p.m. He noted that the meeting is being recorded. The deadline for applications for the March 21st meeting is March 1, 2016 @ 3:00 PM. The next office hours, for the March meeting, is March 1st from 6:00 – 9:00 PM. Dave introduced the members of the commission. Dave asked everyone to turn off/down their cell phones for the duration of the meeting.

Minutes: The minutes from our January 2016 meeting were approved unanimously.

 

Public Hearing – RDA – Submitted by John Wagner, 5 North Lake Ave., map 18A lot 43, regarding the drilling of a well, trench for water pipe & electrical, removal of a tree and repair of stone walls (topsoil added as needed) in the BZ of OR. Dave opened this hearing and invited applicant to address the commission. John not present so Dave made a motion to table the hearing until the end of the meeting; RM 2nd the motion and the commission voted unanimously to table the hearing until the end of the meeting. Dave reopened this hearing at the end of the meeting and applicant is still not in attendance – he did however call and say that he would not make it as he thought since today is a holiday, we would not have the meeting. Dave made a motion for a continuance per applicant request; RM 2nd the motion and the commission voted unanimously to continue this hearing until March 21st.
Public Hearing – RDA – Submitted by Sarah Schultz with SK Design on behalf of Jeff & Teresa Daignault, 408 Pine Road, map 17 lot 46, regarding the permitting of existing docks on OR. Dave opened the hearing and invited applicant to address the commission. Sarah introduced herself and provided the commission with an overview of the work and site plans/maps. Dave asked the commission if there were any questions stemming from the site visit – no questions as plans are very well laid out and explained. Dave made a motion for a -3 determination with the following conditions: OCC reserves the right to inspect property/work for a period of 3 years from date of approval; RM 2nd the motion and the commission voted unanimously to issue a -3 determination with the above conditions.

 

Public Hearing – RDA – Submitted by Gary & Lori McCauley, 5 Old Stagecoach Road, map 17D lot 11, regarding repair of existing dock, restack of seawall, removal of a dead tree and removal of debris and rocks from swim area by hand, all in the BZ of OR. Dave opened the hearing and invited the applicant to address the commission. Dave asked the commission if there were any questions stemming from the site visit, per RM, no questions, plans are straightforward. Per Dave, wants to make sure that applicant knows they cannot dredge, remove or fill any area within the water – they can remove small rocks and debris by hand, but no equipment of any kind can be in the resource area of the work involved, applicant understands. Also, only boards can be replaced on the dock – original footprint will not change. Dave made a motion for a -3 determination with the following conditions: OCC reserves the right to inspect work for 3 years from date of approval; all debris to be removed from resource area daily; no equipment in the resource areas; all work to be done by hand in the water; tree must be removed without the use of heavy equipment – stump cut flush with ground – an veg. oil only in chainsaw. RM 2nd the motion and the commission voted unanimously for a -3 determination with the above conditions.
Public Hearing – Request for Amendment to OOC – Submitted by Solitude Management, on behalf of Lawrence/Beverly Birnbach/Hyman, 1340 West Center Road, map 6 lot 162, regarding the amendment to Final OOC 254-0370, to include mechanical removal of decaying Phragmites and nuisance stick and organic matter buildup in the Birnbach property pond. Dave opened the hearing and invited agent or applicant to address the commission and no one was in attendance. We received an email stating they could not attend and wanted a continuance. Dave made a motion to continue this hearing until our March 21st meeting; RM 2nd the motion and the commission voted unanimously to continue this hearing until the March 21st meeting.
Public Hearing – NOI – Continuation – Submitted by Paula Geddis with R. Levesque, on behalf of Dennis & Anne Marie Stempel, 41 N. Lake Ave., map 18A lot 38, regarding the expansion of existing deck, installation of a removable shed & dock and removal of identified trees. Dave opened the hearing and we still have not received word back from NH/ESP so the applicant requests a continuation until March to allow for NHESP to make a determination. Dave made a motion to continue this hearing until our March 21st meeting; RM 2nd the motion and the commission voted unanimously to continue this hearing until the March 21st meeting.
Public Hearing – NOI – Continuation – Submitted by Paula Geddis with R. Levesque, on behalf of John & Kimberley Tonlino, 511 Pine Road, map 17B lot 70, regarding the installation of a dock, repair of existing stonewall and removal of identified trees. Dave opened the hearing and we still have not received word back from NH/ESP so the applicant requests a continuation until March to allow for NHESP to make a determination. Dave made a motion to continue this hearing until our March 21st meeting; RM 2nd the motion and the commission voted unanimously to continue this hearing until the March 21st meeting.

Submitted by Sarah Schultz with SK Design on behalf of Jeff & Teresa Daignault, 408 Pine Road, map 17 lot 46, regarding the request for COC for work completed under Order of Conditions issued for DEP File 254-0273. Dave opened this hearing after the first Daignault hearing so we could get them out, and not make them wait until the end of the meeting. Dave asked the commission if there were any questions or concerns stemming g from the site visit – RM said that everything looked good and the certificate could be issued. Dave made a motion to issue the C of C for the OOC issued under DEP File 254-0273; RM 2nd the motion and the commission voted unanimously to issue the COC.
