6/21/2022 MEETING MINUTES

 

Location:  Otis Town Hall, One North Main Road, Otis – In-Person Meeting

 

Conservation Commission Members present:  Dave Sarnacki, Roger Meyer, Bruce Wall, Domenic Battista, Jeff Laramy, Jennifer Rivers Cole (new alternate Commissioner).

 

Conservation Commission Members absent:  None.

 

Staff and others present:  Kristen Brown OCC Admin Secretary; Heather Fusick; Patrick O’Brien; Chris Cagenello; John Alicandri; James Fink; David Donahue; Christopher Davis; Jackson Alberti w/Foresight Land Services; Lisa Gelinas; Rick Gelinas; Dan Murray

 

Opening items/Introduction of Commission members and staff.  Dave opened the meeting at 6:00 p.m., and noted that the meeting is being recorded. The deadline for applications for the 7/19/2022 meeting is on Wednesday July 6, 2022 @ 6:00 PM. The next office hours, for the July 19, 2022 meeting, is also Wednesday July 6, 2022 from 6:00 –9:00 PM. Dave introduced the members of the commission, and asked everyone to turn off/down their cell phones for the duration of the meeting.

 

Minutes:  Dave made a motion to approve minutes from the May 18, 2022 meeting; BW 2nd the motion and the Commission voted unanimously to approve the minutes from the May 18, 2022 meeting.

 

  • Public Hearing – RDA – Submitted by Lori Beauchemin, 314 Kibbe Road, map 17C lot 90, regarding the removal of two partially dead trees within the BZ of Otis Reservoir. Dave opened this hearing and asked if any questions stemming from the site inspection and per BW, no issues with this one. Dave made a motion for a -3-determination w/standard conditions; RM 2nd the motion and the Commission voted unanimously to issue a -3-determination w/standard conditions.

 

  • Public Hearing – RDA – Submitted by Norma Wilfried Marchand, 58 Shore Circle, map 11F lot 63, regarding the removal of 13 dead/dying trees within the BZ of Benton Pond. Dave opened this hearing and asked if any questions stemming from the site inspection and per BW, no issues with this one. Dave made a motion for a -3-determination w/standard conditions; RM 2nd the motion and the Commission voted unanimously to issue a -3-determination w/standard conditions.

 

  • Public Hearing – RDA – Submitted by Tops Tree Svc., on behalf of Douglas S. Lombardi, 200 Kingsley Rd., map 7A lot 46, regarding the removal of 4 insect infested & dying trees within the BZ of Watson Pond. Dave opened this hearing and asked if any questions stemming from the site inspection and per BW, no issues with this one. Dave made a motion for a -3-determination w/standard conditions; RM 2nd the motion and the Commission voted unanimously to issue a -3-determination w/standard conditions.

 

 

  • Public Hearing – NOI – Submitted by Kevin & Heather Fusick, 408 Pine Rd., map 17B lot 46, regarding the repair of existing seawall & addition of a patio and firepit on the south side of property, all within the BZ of Otis Reservoir. Dave opened this hearing and asked if any issues and per KB, applicant requested a continuance to the 7/19/22 meeting. Dave made a motion to continue this hearing to the 7/19/22 meeting; RM 2nd the motion and the Commission voted unanimously to continue this hearing to the 7/19/22 meeting.

 

  • Public Hearing – NOI – Submitted by SK Design Group, Inc., of behalf of Joseph Curran, 373 Stanley Rd., map 16 lot 7, regarding the demo of existing house & decks, construction of new house, install of new soil absorption system & well and associated site work, all within the BZ of Big Pond. Dave opened this hearing and asked if any issues stemming from the site inspection and the only comment was from JRC that tree removal is allowed but no touching anything at the water’s edge, and the tree removal and slurry pit need to be added to the plans. Therefore, Dave made a motion to issue the OOC when the new plan is received that shows the slurry pit and any tree removal, w/standard and special conditions. BW 2nd the motion and the Commission voted unanimously to issue the OOC when the new plan is received that shows the slurry pit and any tree removal, w/standard and special conditions.

 

  • Public Hearing – RDA – Continued from 5/18/22 Meeting – Submitted by KJW Env. Svcs., on behalf of Kevin & Lori Randall, 56 S. Gate Island Rd., map 17C lot 13, regarding the repair, replacement & assoc. site-work for new slab & foundation, and subsurface septic (septic is outside 100’ buffer), within the BZ of OR. Dave opened this hearing and asked if information requested was received; per KB: yes, all info was received, and a follow up inspection was conducted and applicant has removed the new structure completely off of state land, so no issues remaining. Therefore, Dave made a motion for a -3-determination w/standard conditions. JL 2nd the motion and the Commission voted unanimously to issue a -3-determination w/standard conditions.

 

  • Public Hearing – NOI – Continued from 5/18/22 Meeting – Submitted by R. Levesque & Assocs., Inc., on behalf of David Foster, 0 Pine Rd., 23 Flint Farm Rd., 29 Flint Farm Rd., map 15C, lots 35, 47 & 48, regarding the repl. & reconstruct of exiting seawall, permanent dock & proposed shared septic system within the BZ & Bank of OR, and BVW. Dave opened this hearing and asked if any issues stemming from the site inspection. The only items stated are that applicant must apply for and obtain a Chapter 91 license w/MA DEP, as well as any required permitting from MA DCR, before work project commences. Therefore, Dave made a motion to issue an OOC w/standard & special conditions to include applicant must apply for and obtain a Chapter 91 license w/MA DEP, as well as any required permitting from MA DCR, before work project commences.   • Public Hearing – NOI – Continued from 5/18/22 Meeting – Submitted by Salvini Assocs. LLC, on behalf of John & Carol Walz, 22 Lion Hill Road, map 11E lot 22, regarding the installation of a walkway with a boardwalk over wetland sections, to access lake-front property. Dave opened this hearing and asked if any issues outstanding. Per BW, approval must include that there is only one full grown tree removal approved and that is the Hemlock; applicant can also remove numerous saplings cut flush w/ground; boardwalk to be 18 to 24” raised off the ground and all material processing & staging must occur outside any resource area(s).         • Extension of OOC 254-0419: Order of Conditions issued under DEP File Number 254-0419, that expires 8/27/2019, and is requested to be extended to 8/27/2025. Dave opened this hearing and asked if any issues with this extension. With none being stated, Dave made a motion to approve the extension of OOC as requested to 8/27/2025; BW 2nd the motion and the Commission voted unanimously to approve the extension of the OOC to 8/27/2025.
