CONSERVATION COMMISSION

02/16/2021 MEETING MINUTES

 

Location:  Otis Town Hall, One North Main Road, Otis ** Remote Meeting Via Zoom ***

 

Conservation Commission Members present:  Dave Sarnacki, Roger Meyer, Domenic Battista, Bruce Wall and Jeff Laramy.

 

Conservation Commission Members absent:  None

 

Staff and others present:  Kristen Brown OCC Admin Secretary; Daniel Giusti; Jackson Alberti w/Foresight Land Services; Chris Tryon w/BGT; Gail Beauregard; Mark Stinson w/MA DEP; others in attendance unknown, as not announced, nor signed-in with a full name on the Zoom application.

 

Opening items/Introduction of Commission members and staff.  Dave opened the meeting at 6:00 p.m.  He noted that the meeting is being recorded. The deadline for applications for the March 16, 2021 meeting is on Wednesday March 3, 2021 @ 6:00 PM. The next office hours, for the March 16, 2021 meeting, is also Wednesday March 3, 2021 from 6:00 –9:00 PM. ** Office hours will be conducted remotely until further notice; in person meetings will be held by appointment only ** Dave introduced the members of the commission, and asked everyone to turn off/down their cell phones for the duration of the meeting.

 

Minutes:  Dave made a motion to approve minutes from the January 19, 2021 meeting; BW 2nd the motion and the Commission voted unanimously to approve the minutes from the January 19, 2021 meeting.

 

  • Public Hearing – RDA – Submitted by Dave Wheeler, on behalf of Nicole & Marc Maddalena, 29 Bay Point Road, regarding the installation of a foundation and frost wall for existing home, within the BZ of Otis Reservoir. Dave opened this hearing and invited applicants to address the Commission. Dave noted that OCC received an email from applicant to withdraw the previously denied RDA; Dave made a motion to withdraw the previous RDA, and therefore, withdraw the resulting denial issued. BW 2nd the motion and the Commission voted unanimously to withdraw the previously submit RDA. Next Dave discussed that the new RDA, as explained at the last meeting, is the one that will replace the previously approved and withdrawn RDA. Dave asked if there were any concerns from the Commission, and with none being said, since this is an exact RDA to the previous, Dave made a motion for a -3 determination with the following conditions: No heavy equipment in the resource areas; any EC needs to be installed and inspected prior to work start; debris to be removed or covered immediately/daily; no other work permitted under this approval. RM 2nd the motion and the Commission voted unanimously to approve and issue a -3 determination with the above conditions.

 

 

 

  • Public Hearing – RDA – Submitted by Carandan Real Estate Trust/Lisa Wendell Trustee, 34 South Gate Island Rd., map 17C lot 9, regarding the removal of old existing boat-lift and reinstallation of new boat-lift in same footprint, in the BZ of OR. Dave opened this hearing and asked the Commission if there were any questions stemming from the site inspection; none being stated, Dave made a motion for a -3 determination with the following conditions: no EC needed; debris to be removed immediately from any resource areas; new lift to be put into same exact footprint. DB 2nd the motion and the Commission voted unanimously to issue a -3 determination with the above conditions.

 

  • Public Hearing – NOI – Continuance from January 19th meeting – Submitted by Foresight Land Svc., Inc., on behalf of Glenn Steinberg, 32 Fawn Ct., map 10 lot 38, regarding proposed addition to single family home and related site-work, all within the 200’ resource area of Benton Brook. Dave opened this hearing and reminded the Commission that this was continued last month due to the receipt of last-minute revision to plans, so OCC continued to allow for a 2nd site inspection to be done, based on the said revised plans. Dave asked the Commission if there were any questions stemming from that 2nd site inspection, and none being stated, made a motion to approve and issue an OOC with the standard and special conditions. RM 2nd the motion and the Commission voted unanimously to issue an OOC with standard and special conditions.

 

  • Public Hearing – NOI – Continued from January 19th Meeting – Submitted by Daniel Giusti, 1555 West Center Road, map 6 lot 172, regarding the installation of a WLC device, to mitigate beaver dam flooding, in the resource area of Benton Brook. Dave opened this hearing and noted that the Enforcement Order was issued, 3rd party Peer Reviewer has been retained to represent the Commission, and site inspections/field work has been scheduled for April 2021, weather permitting. For now, since still no MA DEP file number issued for the NOI, this must be continued. Therefore, with applicant in agreement, Dave made a motion for a continuance until the March 16, 2021 meeting. RM 2nd the motion and the Commission voted unanimously to approve the continuance request.

Dave made a motion to adjourn the meeting at 6:48 PM. RM 2nd the motion and the Commission voted unanimously to adjourn the meeting.
